The estate of a man killed in a crash last month on Interstate 55 has filed a lawsuit against a truck driver involved in the wreck, claiming the driver was speeding and driving recklessly when the accident occurred.
Marcos Figueroa, 26, of Joliet, died after his car was hit by a semi truck on I-55 near Plainfield. Figueroa was near his Grand Prix, which was parked on the shoulder, about 1:40 a.m. March 13, the lawsuit states. That was when a truck driven by John Burch, a Missouri man who worked for Supervan Service Co., hit Figueroa and his car, killing him, the lawsuit said.
Figueroa was the father of a 10-month-old baby, according to the lawsuit.
The administrator for Figueroa’s estate is suing Burch and Supervan Service Co. for more than $50,000 on two counts.
Burch was not charged in the crash, according to Will County court records.
The case is set for an initial appearance in Will County court Aug. 14.
